These terms and conditions regulate the Agreement between "you" the customer and xtar-uk.co.uk
By placing an order with Xtar-uk.co.uk you are offering to purchase the goods detailed within that order, which we may or may not accept at their sole discretion.
All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please don’t use the site.
You agree that all details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.
To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information, supplied by you during or after the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
If for any reason your credit card details are incorrect or there is not enough money in your account or for any other reason the order cannot be processed, Xtar-UK.co.uk will have right to rescind and upon their election to do so, the order will be cancelled.
Our Contract with you
When you place an order to purchase a product from us, you will be sent an e-mail from The Xtar-uk.co.uk website on our behalf confirming receipt of your order and setting out the exact details of your order.
If your order is a wholesale order not processed via the website then we shall send a PI which must be paid within 7 days. Your order will not be shipped until the balance of your order has been received in full. If your order has not been paid after the 7 day period your order will be cancelled and the said stock released back into the warehouse.
We attempt to ensure that the information available on the web site at any one time is accurate. However, Xtar-UK.co.uk assumes no duty to update such information and cannot guarantee that it will be fault-free.
Xtar-uk.co.uk does not accept liability (except as set out below) for any errors and omissions in the presentation of goods on the web site and reserves the right to change information, specifications and descriptions of listed goods and products at any time. Xtar-uk.co.uk will, however, do its best to correct any errors and omissions as quickly as practicable after being notified of them.
Xtar UK Limited does not make any warranty that the web site is free from infection by viruses or anything else that has contaminating or destructive properties.
Xtar UK Limited will only be liable for loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the price of the product purchased in respect of any claim.
Xtar UK Limited shall not be responsible for and disclaims all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, the performance of the products, your or your company’s personal information or material and information transmitted over our system. In particular, neither Xtar UK Lmited nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.
Please wait at least 14 days from the date we confirm that your item has been shipped before reporting any non delivered items. Please be patient and wait 28 days in times of severe weather as this will cause delays in the delivery times for all of our goods.
For UK retail orders we use the Royal Mail to deliver our products to our customers.
For wholesale orders we use a tracked courier service which will require a signature at the point of delivery.
- Retail Special next day deliveries are only guaranteed if the order is complete before 2pm.
- Our Free Shipping Option is shipped Second Class, usually but not guaranteed, the same day of ordering if ordered before 2pm.
- Our other shipping methods are Royal Mail first class, or recorded / signed for post as specified by the customer.
- Orders received by 2pm Monday to Friday (excluding Bank Holidays) we will always strive to ship same day, subject to stock availability.
- Orders placed after 2pm will be shipped the next working day.
- International Retail orders are subject to the country’s importation regulations. We will not accept liability should the goods fail to clear customs for any reason.
- Wholesale orders shall be shipped by a courier of our choice and once shipped is guaranteed next day delivery if ordered Monday - Thursday. Orders received Friday shall carry over until Monday for delivery.
Restrictions / Age Verification
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.
Our products are not bound by an age restriction by UK law, however , by ordering from Xtar UK Limited you confirm that you have the correct technical knowledge to be able to use our products safely. Xtar UK Limited will not be liable for misuse of our products which result in personal injury or other damage.
Ownership & Title
All ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you at the point and time at which such product leaves our premises in the UK.
Xtar UK Limited will only be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you submitted your order to us, or a contract for the sale of goods by us to you was formed.
We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that was not reasonably foreseeable to both you and us when you submitted your order to us or when a contract for the sale of goods by us to you was formed.
Xtar UK Limited does NOT accept responsibility or liability by law, in any way for death or personal injury caused from the use of our products.
Xtar UK Limited assumes no liability for the contents of any other web sites to which the xtar-uk.co.uk web site has links to and shall not be held responsible for any loss or damage caused or alleged to have been caused by use of or reliance on any content, goods or services available on such hyperlinked sites. xtar-uk.co.uk may not have control of such web sites. The inclusions of any hyperlinks to such other web sites does not mean that xtar.co.uk endorses the material on such web sites or has any association with the owner thereof.
All Xtar products are manufactured to the highest possible standards and using the latest available technologies. We are therefore confident that your products will be received without faults.
However, should any part of your order be faulty in any way, please send it back to us within 7 days of your receipt, including all parts, instructions, accessories and packaging. Our Technical Department will inspect the product on receipt to confirm the fault and we will then offer you the choice of either a part refund covering the parts of the product that are unused (including any postage you have paid), or a new replacement (where we will meet the new delivery cost on your behalf).
Wholesale customers must have a POS or tilling system that clearly shows the date and time of purchase and therefore we can make a decision of the item falls into warranty or not.
Should you wish to return the product even if it is not faulty, you will need to return it to us, at your own cost, within 7 days of receipt by you.
A full refund minus the cost of shipping will be issued if the product has been unopened & unused.
No refund will be issued if the product has been used and will be decided at the managements discretion upon inspection of the returned products. This is for hygiene reasons as we cannot resell the atomizer, mouthpieces or e liquid because of the risk of contamination. By buying your item you are agreeing in full to these terms.
If our team of technicians believe a fault has been caused by misuse and not reading / following the instructions correctly then we will offer no refund whatsoever.
All of our products come with a 1 year or 2 year warranty which is clearly shown in the product description.
The warranty period on retail sales starts from the date the unit was shipped to you.
The warranty period on wholesale orders will be determined from the point of sale receipt issued to the customer at the time of purchase. We will only accept and process products under warranty that have a POS receipt. If your company currently operates without a till system that clearly prints the date and product description then we highly recommend moving to the said system.
To return your product, please notify us of the fault in writing, to email@example.com and then post it, along with proof of any postage costs, to:

Events Beyond our Control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your statutory rights.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of Great Britain without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the High Court of Great Britain in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.
